Case results are not typical. We cannot guarantee a particular outcome in any case. It is important that you discuss your unique case with an experienced attorney.
Think You have to Wait for Your Spouse to be a U.S. Citizen?
NO! We had TWO permanent resident applications APPROVED through a permanent resident spouse. NO WAIVER REQUIRED!
How Can My Green Card Holder Spouse Sponsor Me?
In both of these cases, the green card applicant entered to the United States with a visitor visa. The visitor visa means that the client entered the U.S. lawfully. A lawful entry makes the permanent resident process a little easier.
The green card applicant was also married to a permanent resident (LPR or green card holder). In the past green card holders had to wait to become U.S. citizens to apply, but RIGHT NOW they do NOT have to wait.
Whether a green card holder has to wait is determined by a visa bulletin published by U.S. Department of State.
Two VAWA Approvals for Clients with NO Physical Abuse or Criminal Conviction
We had TWO applicants approved for visas based on emotional and financial domestic violence by a U.S. citizen spouse. Both applicants can go on and apply for green cards on their own.
Can a Man Apply for VAWA?
Although it is called the Violence Against Women Act, it is available to ALL genders. ANY person who experiences domestic violence (emotional, physical, financial, or any other type of abuse) by their U.S. citizen or Green Card Holder spouse or parent can apply for VAWA and possibly obtain a green card.
Emergency travel request GRANTED for TWO applicants
We had an emergency travel request granted for TWO clients with pending permanent resident applications. One emergency travel request was granted for an employment opportunity abroad. The second request was granted for the client to attend a funeral of a close family member.
How do I get an Emergency Travel Document?
All green card applicants are eligible to receive a travel document. However, due to COVID, travel documents are taking between 6-9 months to arrive. USCIS has also signaled that the travel documents may take even longer in the future.
What if I Need to Travel Internationally but Do Not Have a Travel Document?
It is important that you do NOT travel until you receive proper documentation from the U.S. government.
If you would like to travel internationally or have your travel document expedited, you must show the government that the travel is necessary and/or you will suffer financial detriment by being unable to travel. Common examples, include death in the family, severe illness of a family member, and work-related travel.
