Isn't Love Enough? Why Did USCIS Issue a Request for Evidence (RFE)

Imagine your marriage-based permanent resident application has been pending for months.
You provided pages and pages of bank statements, photos, lease agreements, and USCIS wants more. Why?

USCIS requires a couple prove they have a “bona fide and genuine” marriage before issuing a permanent resident card commonly called a green card.

USCIS considers several factors when adjudicating a permanent resident application.

Here’s some common reasons for a Request for Evidence (RFE):

  1. You Didn't Provide Enough Evidence with BOTH Spouse's Names: USCIS wants proof that you share a life together. Showing commingling of finances and expenses can help your case.

  2. Your Marriage is Relatively New. USCIS may want more proof of a marriage under 3 years.

  3. You or Your Spouse was Married Before. USCIS requires proof of the dissolution of a marriage before either spouse can remarry. Be sure to include any divorce or death certificates.

  4. Your Case is Being Reviewed by a Person. USCIS officers are people too. Sometimes they want more information before making a decision. Don’t be nervous. Provide USCIS what they ask for!
