USCIS Says It Will REJECT Any New DACA Applications
In a July 28, 2020 memorandum, Acting Secretary of the United States Department of Homeland Security Chad F. Wolf, announced that USCIS will reject any new, initial DACA requests.
What the New DHS Statement Means for the DACA Program
In the memo, Wolf states the following:
The July 28, 2020 memo rescinds the 2017 and 2018 memos relating to the DACA program, which were the subject of the June 18, 2020 Supreme Court decision. Wolf asserts that the Supreme Court did not question the authority of the Department of Homeland Security to rescind the DACA policy, but determined the 2017 and 2018 memoranda did not comply with certain requirements.
USCIS will reject all pending initial DACA applications.
USCIS will reject all future initial DACA applications.
USCIS will reject all pending Advance Parole applications for first-time, initial DACA applicants.
USCIS will accept Advance Parole applications for current DACA recipients in exceptional circumstances only.
The DACA renewal period is shortened from 2 years to 1 years.
The DACA filing fee will remain the same each time, but the frequency of the renewal will increase the financial burden on applicants.
If an individual has already sent in the initial DACA application, USCIS will refund all filing fees associated.
The Holland Law Firm, PLLC Must Postpone the “Free DACA Consultation Day”
The Holland Law Firm, PLLC must postpone the “Free DACA Consultation Day” scheduled for August 6, 2020.
The Free DACA Consultation Day was geared towards individuals who may qualify for DACA now, but did not when the DACA program was initial rescinded in 2017.
We also wanted to celebrate the huge victory at the Supreme Court level with Department of Homeland Security Et. Al. v. Regents of the University of California.
We are in the process of planning another event for the community to be more informed about their immigration options.

What Civil Rights Groups are Saying About the DACA Program
This was tough news for Dreamers and other young undocumented people in the United States. We expect there to be litigation regarding this matter. Several groups, including the American Civil Liberties Union (ACLU) have already issued statements regarding their dedication to the fight for the DACA program.
“Today is another cruel day for Dreamers, their families, and all Americans. But we promise, just like the Dreamers, who have fought for decades, we won’t stop fighting.”
-Andrea Flores, deputy director of immigration policy for the American Civil Liberties Union
