Case Results: Plea Deal Reached!

Tatiauna Holland of the Holland Law Firm, PLLC represented a client that was charged with online solicitation of a minor in October of 2016. The client was facing charges related to a sting operation in Montgomery County called "Operation Safe Holiday", which resulted in the arrest of 36 individuals.

Please note: Our client did not communicate online with an actual minor. All communications or conduct which resulted in criminal charges occurred with and between an adult uncover police officer.

Conroe Online Solication of a Minor Defense Lawyer

Our client was charged with Online Soliciation of a Minor, a second-degree felony, and faced between 2 to 20 years imprisonment, and mandatory registration as a sex offender. Montgomery County District Attorney's Office asserted that it is county policy to not offer deferred adjudication or probation for certain sex offenses, even first-time offenders.

Having a client involved in such a high-profile sting operation was a challenge, because the particular facts of the case are not always considered by the prosecutors and the public (who will eventually serve on the jury in a trial).

Initially, the prosecutors offerred our client 8 years imprisonment and lifetime registration as a sex offender. After much advocacy on behalf of our client and showing the equities in the case, including our client had never committed a crime in any state, was barely over 21 at the time he allegedly communicated online with the undercover cop, and the client's mental health following the death of a parent.

We were able to negotiate the client's sentence to 2 years imprisonment (with time-served or back time) and 10 year registration--The minimum sentence available. While any amount of prison time can be difficult to handle, the particular plea was the strongest option for the client. 

During his sentence the client intends to undergo grief counseling, rehabilitation, and pursue a college education. Best of luck to the client.
